Recognizing the unequal bargaining power between companies and consumers, the Supreme Court rejected a forum selection clause requiring that legal actions taken against Facebook should be taken in California. The Supreme Court decision stroke down a B.C. Court of Appeal decision that ruled that a privacy class action could not proceed because the company terms and conditions provided the disputes must be resolved in Santa Clara, California.
